Terms of Service
The terms for running your business with Qadam, including connected channels and AI-assisted workflows.

1. The service and these Terms
The Qadam Technology (“Qadam”, “we”, “us”, or “our”) provides software for businesses and store owners to manage products, inventory, customers, orders, customer interactions, supported WhatsApp, Facebook, and Instagram integrations, and AI-assisted workflows (the “Services”). These Terms of Service, also called Terms & Conditions (“Terms”), govern your business use of the Services.
By accepting these Terms, creating an account, subscribing, or using the Services, you agree to these Terms on behalf of yourself and the business you represent. If you do not agree or are not authorized to bind that business, do not use the Services. An expressly agreed written service agreement or order form controls where it conflicts with these Terms for the subject it covers.
2. Eligibility and account responsibility
You must be a business owner or authorized staff member, be legally capable of entering into a binding agreement, and have authority to use the business accounts and information you provide. You must supply accurate account, billing, and business information and keep it up to date.
You are responsible for safeguarding account credentials, assigning appropriate staff permissions, and activity carried out through your account. Do not share access with unauthorized people. Notify us promptly of suspected unauthorized access at support@theqadamtechnologies.com.
3. WhatsApp, Facebook, and Instagram integrations
The Qadam Technology may enable businesses to connect supported Meta products, including WhatsApp Business, Facebook Pages, and Instagram accounts. By connecting a supported account, you authorize Qadam to access and process permitted information solely to provide the enabled features, as described in our Privacy Policy.
You must have authority over the connected accounts. Connections depend on account eligibility, permissions, verification, API availability, and any required third-party approvals. Use of Meta products remains subject to Meta’s applicable terms, policies, and platform rules, including the Meta Platform Terms and WhatsApp Business Messaging Policy.
Qadam is an independent software provider and is not WhatsApp, Facebook, Instagram, or Meta. An integration does not imply endorsement or partnership. You may revoke permissions through the relevant provider; revocation does not automatically delete existing Qadam records.
4. Your messaging and commerce responsibilities
You are responsible for obtaining and maintaining the necessary notices, permissions, consents, and lawful basis to collect customer information and message customers. Honor opt-out requests and comply with applicable messaging, privacy, consumer protection, and commerce laws and the connected platform’s policies.
You are responsible for your message content, recipients, campaigns, approved templates where required, and any automated workflows you enable. You must provide an appropriate route for customers to reach a person when needed. Qadam does not guarantee that messages will be approved, delivered, or read.
Your store remains responsible for the goods or services it sells, descriptions, pricing, taxes, stock accuracy, delivery, customer support, returns, refunds, and disputes with customers. Qadam supplies business software and is not the seller of your store’s products.
5. AI-assisted features
Certain features use artificial intelligence to interpret customer messages, identify products, quantities, requests or order intent, and assist with business workflows. Enabled features may send message text and related information to a configured AI provider, as explained in our Privacy Policy.
AI-generated results may be incomplete or inaccurate. Review important outputs and actions, including product choices, quantities, prices, availability, customer commitments, and order confirmations. AI results should not be the sole basis for important business, legal, financial, or customer-service decisions. You remain responsible for the workflows you authorize and the actions you approve.
6. Subscriptions, billing, and payments
Available plans, prices, currency, billing frequency, included features, usage limits, and any applicable GST or other taxes are shown in the relevant plan offer, checkout, or written agreement before you subscribe. There is no fixed plan price in these Terms. You agree to pay the charges you accept and to provide accurate tax and billing details.
Where recurring billing is offered and authorized, the subscription renews at the billing frequency you selected until cancelled. Any separate messaging, AI, payment gateway, or third-party usage charges must be disclosed in the applicable offer or agreement. A Qadam subscription does not automatically include all third-party fees.
Upgrades, downgrades, effective dates, and any prorated charges or credits follow the terms presented when you request the change or our written agreement. Do not assume an immediate downgrade or a credit unless it is confirmed. A change may alter limits or feature access.
If a payment fails or remains overdue, we may ask you to update your payment method and may restrict or suspend paid features until payment is resolved. Any grace period is governed by the applicable plan or written notice. Price changes will be communicated before they apply to a future renewal, where required by law.
7. Cancellation and refunds
You may cancel your subscription at any time through an available cancellation control or by contacting support@theqadamtechnologies.com. Cancellation stops the next renewal and takes effect at the end of your current paid billing period. You retain access to the applicable paid features until that period ends, unless access is separately suspended or terminated under section 10.
Except where required by applicable law or expressly agreed by The Qadam Technology, subscription fees already paid are non-refundable. Cancellation, unused time, a downgrade, or unused usage allowances do not by themselves create a right to a prorated refund. Any refund we approve will be processed using the original payment method where reasonably possible.
Cancellation does not remove charges already incurred. Disconnecting a Meta account, deleting an app from a device, or ceasing to use the Services does not by itself cancel a subscription. Account cancellation and deletion of stored data are separate requests.
8. Acceptable use and software rights
You must not use the Services to:
- Send spam, harass people, impersonate others, commit fraud, or distribute deceptive or unlawful content.
- Sell, promote, or facilitate illegal products or services, or products prohibited by the connected provider’s rules.
- Introduce malware, attempt unauthorized access, interfere with the service, or access another business’s data without authorization.
- Misuse Meta APIs, use unauthorized integration methods, evade account restrictions, bypass platform limits, or circumvent security or billing controls.
- Infringe intellectual property, privacy, or other rights, or use the Services in violation of applicable law.
While your account is authorized and in good standing, you may use the Services for your business operations within your plan. Qadam and its licensors retain rights in the software, design, and documentation. Do not copy or resell the Services or reverse engineer them except where applicable law permits it.
9. Customer and business data
You retain your rights in the business and customer information you provide. You are responsible for its accuracy, lawful collection, permissions, and your obligations to customers. You authorize Qadam and its service providers to process that information as needed to deliver the features you enable and perform the applicable agreement.
Data handling, sharing, retention, and privacy rights are described in our separate Privacy Policy. Follow the data deletion instructions to request removal of stored information. Keep appropriate copies of important business records; the Services are not a substitute for your own recordkeeping obligations. We do not promise that every record can be recovered after deletion or termination.
10. Suspension and termination
We may restrict, suspend, or terminate access for material violations of these Terms, non-payment, fraud, security risks, abuse, unlawful activity, or violations of Meta or WhatsApp rules. Immediate action may be necessary to protect customers, the service, or connected platforms, or to comply with a legal requirement.
Where reasonably practicable and appropriate, we will explain the reason and provide an opportunity to resolve it. Contact support if you believe a restriction is mistaken. Suspension or termination does not eliminate amounts already owed or any refund rights required by law. Retention and deletion of records remain governed by the Privacy Policy and applicable obligations.
11. Third-party services
The Services may depend on Meta and WhatsApp, AI providers, hosting and database providers, email services, payment gateways, and other providers. Their own terms and privacy practices may apply. Their outages, pricing changes, permission changes, account restrictions, or discontinued APIs can affect features and availability.
We do not control third-party decisions and cannot guarantee their continued availability, message delivery, approvals, AI results, or payment processing. We may change integrations or offer alternatives where reasonably possible, but a particular third-party integration is not guaranteed indefinitely.
12. Availability and service expectations
We aim to provide reliable Services, but do not guarantee uninterrupted, error-free, or continuously available operation. Maintenance, internet problems, security incidents, and third-party failures may cause interruptions. Features may vary by plan, account eligibility, and configuration.
To the extent permitted by applicable law and unless an express written agreement says otherwise, the Services are provided on an “as available” basis without a guarantee of specific business results, sales, or suitability for every purpose. Nothing in these Terms excludes a warranty, remedy, or obligation that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by applicable law, Qadam is not liable for indirect, incidental, consequential, or special losses, including lost sales, profits, opportunities, goodwill, or data arising from use of or inability to use the Services.
Subject to applicable law, Qadam is not responsible for losses caused by third-party outages or decisions, Meta account restrictions, messaging interruptions, inaccurate AI outputs, or customer actions outside our control. This does not remove any responsibility that applicable law imposes on us for our own conduct.
These limitations do not exclude liability that cannot legally be limited, including liability for fraud or willful misconduct where applicable, or any non-waivable rights or remedies. If applicable law does not permit a particular exclusion, it applies only to the extent the law allows.
14. Service changes, governing law, and disputes
We may update features, integrations, plans, and these Terms as the Services develop. The date at the top identifies this version. Material changes will be communicated through an appropriate channel, such as an account notice or email, before taking effect where required. If you do not agree to updated Terms, you may stop using the Services and cancel your subscription under section 7. Existing non-waivable rights remain unaffected.
These Terms are governed by the laws of India. Disputes arising from these Terms or the Services are subject to the jurisdiction of the competent courts in India. No exclusive city or court is designated by this version. Before initiating proceedings, we encourage you to contact support so we can try to resolve the issue; this does not restrict any right to seek a remedy or urgent relief available under applicable law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Provisions that by their nature need to survive termination, including outstanding payments, software ownership, and applicable liability provisions, continue to apply.
